Non-Discrimination Requirements

Discrimination is prohibited for all insured plans for plan years beginning 9/23/2010 and after.  Enforcement has been delayed until regulations are finalized and issued.

A requirement that employer-based coverage not discriminate based on health status. Coverage under employer-based plans cannot be denied or restricted. A person also can't be charged more because of health status. Employer-based plans can restrict coverage based on other factors such as part-time employment that aren't related to health status.
