Using the Monthly Measurement Method to Track Eligibility

Dear Jon,

When using the Monthly Measurement Method to track eligibility, may we offer coverage after the month has been processed?  Are we responsible to offer coverage the same month even though we’re unsure of the hours worked by variable hour employees?  Are we responsible for a type of “retro-eligibility,” is there an ACA Guideline, and if so, where can I find this specific guideline?

I have a question about health insurance for our employees:  We had to get a plan for all the employees and we already had a plan in place for our full-time crews.  Can we still maintain those plans for the full-time employees and offer the new employees the new plan?

Potential Employer Liability from Health Insurance Exchange

Dear Jon,

I am a large employer and offer a health plan to my employees, but some of them have opted out.  Will I be subject to a tax penalty if these individuals go to a health insurance exchange?  And how will I know if my employees go to a health insurance exchange? Is there some sort of notification process?
